Guided Search Tutorial

The Guided Search is our preferred method! It's easy to use our extensive list of variables to customize your search. Find only the cases that fit all of your requirements by selecting any combination of one or more of the following variables:
  • Asylum country
  • Court name
  • Case date
  • Claimant's country of origin
  • Applicable Hathaway Numbers
  • Concepts used in the case
  • Case name

Guided Search Example

For Example, you want to see only the cases that involve refugees fleeing Somalia who made claims in Australia from 1995 to 2000. In order to achieve only the desired results, you would:
  • Select Australia from the Decided In list.
     Try It Out!
  • Select January 1995 as the start date.  
     Try It Out!
  • Select December 2000 as the end date.  
     Try It Out!
  • Select Somalia from the Claimant's Origin list.  
     Try It Out!
  • Click the Search button at the bottom of the search criteria screen to generate the result list.
     Perform the Search!

Understanding Hathaway Numbers  

You can search the database using the chapter and section numbers of Professor James Hathaway's treatise, The Law of Refugee Status, to find cases that deal with specific themes. In The Law of Refugee Status, Professor Hathaway's discussion of the Convention refugee definition is divided into six major chapters:
  • Legal Evolution of Definition
  • Alienage
  • Genuine Risk
  • Persecution
  • Nexus to Civil or Political Status
  • Cessation and Exclusion
Specific themes within each of the elements of the definition are taken up in sub-chapters. The numbering system corresponds to each of these chapters and sub-chapters.

The Hathaway Numbers allow you to perform searches by topic, in a way that ensures you will get the cases you need even when they do not contain particular phrases of the kind that would be picked up by a full text search.

Using the Concept Selection Tool  

The Concept Selection Tool gives you the ability to select either one or multiple concepts for your search. The Concept variable will help you narrow down your search to find cases that deal with concepts relevant to your interest. You can use the Concept variable to find cases that deal with:
  • Specific kinds of refugee claims, such as those based on fear of arbitrary arrest, involving women, or which raise concerns of illegal entry
  • Issues in the interpretation or application of the refugee definition, such as benefit of the doubt, causation, or the direct flight rule
